TERMS & CONDITIONS
The Global Fit Club is a collection of digital memberships (NFTs) running on the Ethereum network. This website is only an interface allowing participants to buy digital collectibles in presale and receive information about the project. Users are entirely responsible for the safety and management of their own private Ethereum wallets and validating all transactions and contracts generated by this website before approval. Furthermore, as The Global Fit Club smart contract runs on the Ethereum network, there is no ability to undo, reverse, or restore any transactions.
This website and its connected services are provided “as is” and “as available” without a warranty of any kind. By using this website, you are accepting sole responsibility for any and all transactions involving The Global Fit Club digital collectibles.
MEMBERSHIP
Each Global Fit Club NFT is equivalent to one universal gym membership. Therefore, once the data base for participating gyms is launched to verify identity, you and only you can use that membership. They cannot be shared amongst others. If a friend or family member wants to participate, they will either need to purchase their own Global Fit Club NFT, or you can gift them one of your Global Fit Club NFTs to their separate wallet.
Upon signing up to the gym, all memberships, liabilities, and insurance procedures are between you and the participating gyms. The Global Fit Club is not responsible for any liability. We provide you with access and discounts to the participating gyms, the agreements are between you and them. Our gyms we are partnered with will be constantly growing and changing. We reserve the right to add or remove participating gyms without notice to the NFT holders. The updated list of participating gyms will be on our website and is the responsibility of the NFT holder to check what gyms they have access to at any given time. This access includes in person and virtually for any given service provided by said gym.
OWNERSHIP
You Own the NFT
Each Global Fit Club is an NFT on the Ethereum blockchain. When you purchase an NFT, you own the underlying Global Fit Club Token, completely. Ownership of the NFT is mediated entirely by the Smart Contract and the Ethereum Network: at no point may we seize, freeze, or otherwise modify the ownership of any The Global Fit Club Token.
Personal Use
Subject to your continued compliance with these Terms, we grant you a worldwide, royalty-free license to use, copy, and display the purchased Art, along with any extensions that you choose to create or use, solely for the following purposes:
· for your own personal, non-commercial use;
· as part of a marketplace that permits the purchase and sale of your Global Fit Club NFT, provided that the marketplace cryptographically verifies each Global Fit Club Token owner’s rights to display the Art for their Global Fit Club Token to ensure that only the actual owner can display the Art.
· as part of a third-party website or application that permits the inclusion, involvement, or participation of your Global Fit Club Token, provided that the website/application cryptographically verifies each Global Fit Club Token owner’s rights to display the Art for their Global Fit Club Token to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of Global Fit Club Token leaves the website/application.
Commercial Use
Subject to your continued compliance with these Terms, we grant you an unlimited, worldwide license to use, copy, and display the purchased Art for the purpose of creating derivative works based upon the Art (“Commercial Use”). Examples of such Commercial Use would e.g., be the use of the Art to produce and sell merchandise products (T-Shirts, etc.) displaying copies of the Art. For the sake of clarity, nothing in this Section will be deemed to restrict you from
· owning or operating a marketplace that permits the use and sale of Global Fit Club Token generally, provided that the marketplace cryptographically verifies each Global Fit Club Token owner’s rights to display the Art for their Global Fit Club token to ensure that only the actual owner can display the Art.
· owning or operating a third-party website or application that permits the inclusion, involvement, or participation of Global Fit Club Tokens generally, provided that the third-party website or application cryptographically verifies each Global Fit Club Token owner’s rights to display the Art for their Global Fit Club token to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the purchased Global Fit Club token leaves the website/application;
· or earning revenue from any of the foregoing.
